This petition has been filed to modify the condition imposed on the petitioner by an order dated 11.07.2023 in Crl.O.P.No.14171 of 2023 to execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate Court-II, Coimbatore.
2. It is the submission of the learned counsel for the petitioner that while ordering bail to the petitioner, this Court directed the petitioner to execute a bond for a sum of Rs.25,000/- with two sureties, each for a like sum. When the petitioner's mother and grand-mother stood as sureties, the surety papers were returned stating that no proof for Rs.25,000/- surety is enclosed.
3. This Court is of the view that, return of the surety memo seeking for proof is unwarranted. Therefore, learned Judicial Magistrate is directed to accept the sureties based on the identity cards produced by the sureties like Aadhar card or any other identity cards approved by the Government and get the bail bond for a sum of Rs.25,000/-.
