JUDGMENT

(Delivered by the Hon'ble Chief Justice) Heard Ms.G.Hema, learned counsel for the appellants; and Mr.L.Chandrakumar, learned counsel for the respondent.

2. Under the impugned order, the learned Single Judge has directed the appellants to publish the date of Counselling/ Certificate Verification in their website. On the date of such Counselling/Certificate Verification, the respondent/original petitioner was directed to present the copy of the interim order and on production of such order, the appellants were directed to conduct the necessary Counselling/Certificate Verification and report before the learned Single Judge on the next date of hearing.

3. The said order is passed on 12.6.2023. The appeal, it appears, was presented with the condonation of delay

application. The delay was condoned and thereafter the appeal came to be registered on 26.9.2023.

4. The order impugned is an interim order. The writ petition is still pending before the learned Single Judge. Even if the appellants conduct the counselling and certificate verification, the process would be provisional, subject to the final decision in the writ petition.

5. In the light of that, as the writ petition is still pending and the order is passed more than three months back, we are not inclined to entertain the present appeal. It is for the appellants to contend on merits at the time of hearing of the writ petition before the learned Single Judge.

6. With these observations, the writ appeal is disposed of. The appellants may abide by the interim order passed by the learned Single Judge, subject to final decision in the writ

petition. There will be no order as to costs. Consequently, C.M.P.No.22408 of 2023 is closed.
