The petitioner, who was arrested and remanded to judicial custody on 27.05.2025, in connection with Crime No.133 of 2025 registered on the file of the respondent police, for the alleged offences punishable under 5(l) r/w Section 6 of Protection of Children from Sexual Offences Act, 2012, seeks bail. 1/4

2. The case of the prosecution is that the accused, who is a married man, had kidnapped the minor victim girl and committed penetrative sexual assault on her. Hence the case.

3. The contention of the learned counsel appearing for the petitioner is that the petitioner is innocent and has been falsely implicated in this case. He further submitted that due to some misunderstanding, a false complaint has been lodged against the petitioner by the de facto complainant and further, the investigation has almost been completed. Hence, he prayed for bail.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and opposed for granting bail to the petitioner. He further submitted that the statement has been recorded from the victim girl under Section 183 BNSS.

5. Heard both sides and perused the materials available on record including the victim's statement under Section 183 BNSS. 2/4

6. Considering the facts and circumstances of the case, submissions made by the learned counsel on either side and taking note of the statement given by the minor victim girl, this Court is not inclined to grant bail to the petitioner.
