O R D E R

This writ petition has been filed for a direction forbearing the 1st respondent from proceeding with the enquiry on the petition made by the 3rd respondent before the 2nd respondent seeking to transfer patta with respect to 0.21 acres of land comprised in S.F. No.116/8B situated at Agaram Sigoor Village, Kunnam Taluk, Perambalur District in view of pendency of the suit in O.S. No.33 of 2023 on the file of District Munsif cum Judicial Magistrate, Kunnam.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the entire materials available on record.

3. It is the grievance of the writ petitioner that as the suit between the parties is already pending in O.S. No.33 of 2023 on the file of District Munsif Page 2/4

cum Judicial Magistrate, Kunnam, his application for mutation was not considered.

4. Learned Additional Government Pleader appearing for the respondents would submit that during pending of the original suit, mutation will not be effected. The said statement is recorded.

5. Accordingly, the writ petition is disposed of. No costs. However, there is no order as to costs.
