This petition is filed to condone the delay of 568 days in filing the appeal.
Heard Mr.R.Marudhachalamurthy, learned counsel for the petitioner and Mr.M.Krishnamoorthy, learned counsel for the second respondent, who has no objections in condoning the delay, provided, the petitioner appellant cannot claim any interest during the delay period. Despite notice having been served upon the first respondent, none appears before this Court.
Having been satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 568 days in filing the appeal is condoned.
Accordingly, the petition stands ordered with a condition that the appellant petitioner cannot claim any interest during the delay period.
