ORDER

The petitioner, who apprehends arrest for the alleged offences under

Sections 118(1), 296(b), and 351(3) of B.N.S. in Crime No.154 of 2026, on the file of the respondent police seeks anticipatory bail.

The case of the prosecution is that on 14.06.2026, due to a dispute relating to repayment of money alleged to have borrowed by the petitioner from his sister, a quarrel arose between the parties, which led to a commission of offences such as abuse in filthy language, criminal intimidation and causing simple injuries. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has nothing to do with the commission of offence as alleged by the prosecution. He would also submit that according to the prosecution, the petitioner abused the defacto complainant, who is his sister, in filthy language, assaulted her and caused criminal intimidation, in fact, the petitioner was the victim in the very same occurrence and he was admitted in the hospital, as his sister assaulted him. He would further submit that there is a case and counter case, that the co-accused A1 was arrested and remanded to judicial custody and the petitioner is ready and willing to abide by any condition that may be imposed by this Court and prays to grant anticipatory bail to the petitioner.

4. At this juncture, the learned Government Advocate (Crl.Side) appearing for the respondent police strongly objected to grant anticipatory bail

to the petitioner on the ground that the injured is still taking treatment in the hospital.

5. Heard the submissions made by the learned counsel on either side and perused the materials available on record.

6. The learned counsel would submit that the issue is between the sister and brother in respect of money transactions and this case is a case in counter. From the submissions made by the learned Government Advocate, it is seen that the injured is still taking treatment in the hospital. In such view of the position, this Court is of the firm view that it is not appropriate to enlarge the petitioner on anticipatory bail.

7. Accordingly, this Criminal Original Petition is dismissed. 24-06-2026 MJS Note:
