This petition is filed to enlarge the petitioner on bail pending investigation in Crime No.350 of 2023, on the file of the respondent Police. 2.It is the submission of learned counsel for the petitioner that petitioner is falsely implicated as accused in Crime No.350 of 2023 for the offence under Section 6 (b) r/w 24 (1) of COTPA Act and Section 328 of I.P.C. He is in judicial custody from 23.07.2023. He further submitted that there is no previous case pending against this petitioner. Thus, this petition is filed for seeking bail.
3.In response, the learned Additional Public Prosecutor submitted that on 23.07.2023, at about 09.00 a.m, respondent Police mounted surveillance near Pothanur Junction. They had previous information that four persons would come with tobacco products. At about 10.00 a.m., they found four persons in four two-wheelers with white color plastic sacs. On seeing the Police, they tried to escape. However, Police apprehended them. On searching the plastic bags, they found the following tobacco products from four persons namely Mageshkumar, Rajeevan, Radhakrishnan and 1/3
K.V.Umarmukthar, i)XL 01 Premium - 12kg, ii)Raj Niwas - 12kg, iii)Hans - 15kg, iv)Vimal 17kg, v)V-1 - 6kg. The investigation in this case is pending. This case is registered on 23.07.2023. 4.Considered the rival submissions and perused the records. 5.Considering the large volume of tobacco products seized from the possession of accused and that investigation in this case is in preliminary stage, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. 09.08.2023 ep 2/3
