ORDER

The petitioner, who apprehends arrest for the alleged offences under Sections 4(1)(A) of the Tamil Nadu Prohibition Act, 2024 in Crime No.39 of 2026, on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that on 20.03.2026, when the respondent police were on regular patrol duty, they found the accused with illegal possession of 90 bottles each containing 190 ml of Brandy without valid license. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has nothing to do with the commission of offence as alleged by the prosecution. He would also submit that the petitioner is ready and willing to abide by any condition that may be imposed by this Court and prays to grant anticipatory bail to the petitioner.

4. At this juncture, the learned Government Advocate (Crl.Side) appearing for the respondent police strongly objected to grant anticipatory bail to the petitioner on the ground that the petitioner has 2 similar nature of previous cases.

5. Heard the submissions made by the learned counsel on either side and perused the materials available on record.

6. Considering the submissions made by the learned Government Advocate and upon the fact that the petitioner has 2 previous cases of similar nature, this Court is of the firm view that it is not desirable to enlarge the petitioner on anticipatory bail.

7. Accordingly, this Criminal Original Petition is dismissed. 24-06-2026 MJS Note:
