The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 341, 324, 506(ii), 147, 365, 323 and 34 of IPC, in Crime No.496 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution as per the defacto complainant is that one Ramu has mortgaged a Innova car bearing Registration No.TN 47 AK 0333 with him and obtained a sum of Rs.2,50,000/- from him. On 09.07.2023, the accused enquired about the said car and forcefully abducted the defacto complainant in their car and when the defacto complainant try to escape from the car, they have stabbed him with knife. Thereafter, the accused left the defacoto complainant at Salem and threatened him not to disclose about the same to the police. Hence the case. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the case property has been seized. Hence, he prayed for grant of anticipatory bail to the petitioner. 1/3

4.Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that due to the dispute over the mortgaged property, the petitioner along with other accused have abducted the defacto complainant and stabbed him with knife. He further submitted that the case property has also been seized. However, he opposed for grant of bail to the petitioner.

5.Heard the learned Counsel on either side and perused the materials available on record.

6.After hearing the rival parties and also taking note of the fact that the trial Court has rejected anticipatory bail application for A3 namely Sanjay and considering the overtact, I find that both the petitioner and the said Sanjay stands on the similar footing, this Court is not inclined to grant anticipatory bail to the petitioner.

7.Accordingly, this Criminal Original Petition is dismissed. 09.08.2023 vkr 2/3
