This matter is listed, pursuant to a mention being made by both the counsels.

2.Both the counsels would submit that the Arbitrator, appointed by this Court earlier on 07.07.2025, has expressed his difficulty to act as an Arbitrator due to some conflict of interest.

3.In view of the same, both the counsels have filed a Joint Memo dated 14.07.2025. Even though they have submitted a panel of Arbitrators, they have made a joint endorsement in the court bundle https://www.mhc.tn.gov.in/judis

vga stating that the parties to the dispute have agreed for the appointment of Hon'ble Mr.Justice K.Govindarajan, Former Judge of this Court to act as the Presiding Arbitrator to adjudicate the dispute between the parties arising out of the contract dated 28.10.2016. 4.In view of the joint endorsement made by both the counsels, on instructions, this Court appoints Mr.Justice K.Govindarajan, Former Judge of this Court as the Presiding Arbitrator to adjudicate the dispute between the parties arising out of the contract dated 28.10.2026. The remaining part of the operative portion of the order dated 07.07.2025 passed by this Court shall remain unaltered.
