Writ petition filed under Article 226 of the Constitution of India praying for a writ of Mandamus directing the 1st respondent to implement the Go.Ms.No.171 P & AR Department Dated 28.09.2006 and fix the salary on par with his junior and sanction the arrears of pay and allowances to the petitioner and grant the consequential monetary benefits with interest within a reasonable time.

ORDER

The request made by the petitioner, who is a retired Assistant Section Officer for stepping up of pay on par with his juniors, came to be rejected vide communication of the Revenue, [OP1(2)] Department, Secretariat, Chennai-9, dated 18.12.2008 vide Letter No.33851/O.P.1(2)/2007-6.

The learned Special Government Pleader undertook to furnish a copy of the same to the learned counsel for the petitioner.

In the light of the said development, nothing survives for adjudication in this Writ Petition and therefore, it is closed.

However, if the petitioner is so advised and if it is open to him under law, he is at liberty to challenge the said communication in accordance with law before the competent forum. No costs.
