ORDER

The petitioner, who was arrested and remanded to judicial custody on 13.06.2026 for the alleged offences under Section 6 and 24(1) of Cigarettes and

Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution)Act, 2003 and under Section 123, 275 and 286 of BNS, 2023 ( 328, 273, 284 of IPC) in Crime No. 207 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 12.06.2026, based on the secret information, the respondent police went to the place of occurrence and found that petitioner along with other accused persons were in illegal possession of 666.24Kgs of banned Tobacco products for sale and the same was seized by the respondent police. Hence, the case.

3. The learned counsel for the petitioner submitted that the allegation against this petitioner that she was in illegal possession of 25 packets of banned Tobacco products. He further submitted that the petitioner's grand daughter is fixed on 24.06.2026 and she is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner.

4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that the petitioner has twelve previous cases pending against her. Hence, he opposed the grant of bail to the Petitioner.

5. I have given my anxious consideration to either side submissions and perused the materials available on record.

6. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); there are no materials available before this Court in support of the submission made by the learned counsel for the petitioner. Considering the totality of the circumstances and upon the fact that the petitioner has twelve previous cases pending against her, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed. 23-06-2026 SHL To:
