The present writ petition has been filed to issue a Course Completion Certificate of Certified Radiology Assistant.
2. Heard the learned counsel for both sides and perused the materials available on record.

The learned counsel for the petitioner would submit that the petitioner has joined the 'Certified Radiological Assistant' course (hereinafter called as 'CRA' for brevity') in the year 2010-2011 in the 3rd RespondentInstitution. The 3rd Respondent-Institution had given a course completion certificate during June-2011 as the petitioner has completed all his examination and cleared the same. The said course completion certificate has to be approved by the respondents 1 and 2 and they have to issue certificate to that effect. In this connection, the petitioner has sent a representation on 07.04.2022 to the respondents 1 and 2 and they did not pass any order upon 2/6
the said representation. It is the further submission of the learned counsel for the petitioner that the similarly placed persons were also given CRA certificate. Therefore, the petitioner, who has undergone the course for a period of one year is also eligible to have a certificate otherwise his study would go waste.

The said submission was strongly objected by the learned Government Advocate appearing for the respondents 1 and 2 by relying upon the Prospectus issued by the Government of Tamil Nadu for the year 20102011 for the admission to Para Medical Courses, wherein for the course of CRA, the maximum upper age limit was fixed as 30 years as on 31.12.2010 for General Category candidates and for the SC/ST candidates the upper age limit is 35 years. For ready reference, the same is extracted hereunder:- "For Medical Record Technician and Diploma in Medical Record Science Courses, the candidates must have completed 18 years of age and should not have completed 30 years as on 31.12.2010 and for SC/ST candidates the upper age limit is 35 years as on 31.12.2010."

It is the further submission of the learned Government Advocate for the respondents 1 and 2 that having the Prospectus fixing 30 years for General Category and 35 years for SC/ST Category as the upper age limit, since because the petitioner has completed the course, he cannot be construed as a person to have the course certificate as the same would go against the Prospectus. It is the further contention of the respondents 1 and 2 that no one had been given course certificate, who was crossed the upper age limit and therefore, prayed to dismiss the writ petition.
6. I have given my anxious consideration to the submissions made on either side.
7. The short point to be considered in the present case is whether the petitioner was qualified to be admitted in CRA course at the time of his admission. In this regard, it is appropriate to refer the Prospectus for the year 2010-2011 for the admission to Para Medical Courses issued by the Government of Tamil Nadu, where it has been specifically mentioned that the upper age limit is 30 years for the General Category candidates and 35 years for the SC/ST Category candidates. It is an admitted fact that the 4/6
petitioner completed the course during 2011 and at that point of time, his age is beyond 37 years, which is beyond the age limit prescribed in the Prospectus. Therefore, admittedly, he is not qualified to be admitted in the CRA course. Therefore, when a person's admission at the very threshold is contrary to the Prospectus cannot claim the certificate since because he has completed the course. Therefore, this Court absolutely does not find any merits in the present writ petition.
