ORDER

The present application has been filed seeking permission to the applicant/petitioner to deal with the properties of K.Vijayal, mentally ill person, as set out in the schedule.

2. The learned Senior counsel appearing for the applicant would submit that, the applicant who had been appointed as Guardian by this Court, is facing difficulties in operating the Bank accounts mentioned in Item Nos.1 to 6 of the schedule to the Judge's Summons and also with respect to Item 1/4

Nos.7 and 8, as she is unable to deal with the said properties. She would submit that the Banks, where the accounts in Item Nos.1 to 6 stand, are seeking a specific order from this Court, permitting her to operate the accounts on behalf of the Ward. Hence, she seeks permission of this Court to deal with the properties of the Ward.

3. I have considered the submissions made by the learned Senior counsel appearing on behalf of the applicant.

4. By order dated 01.04.2024, this Court had appointed the applicant as the Guardian of the Ward, not only of the person but also of the properties. The same would include both the movable and immovable properties as given in Schedule A and Schedule B to the petition. Even though the details of Banks have not been given in Schedule B, the applicant had already been permitted to handle the interest from the Savings Bank and the deposits given in Item Nos.1 to 6 of the Judge's Summons. Therefore, I find no impediment in ordering the present application as prayed for.

5. In fine, the present application stands allowed on the following terms;

(1) The applicant is permitted to deal with Item Nos.1 to 2/4

6 in the schedule appended to the petition with the respective institutions.

(2) The respective institutions shall permit the applicant to operate the accounts on behalf of the Ward.

(3) The applicant is permitted to sell Item Nos. 7 and 8 mentioned in the Schedule to the Judge's summons of the application. Immediately upon sale of Item Nos. 7 and 8, the applicant shall deposit the sale proceeds in a Nationalized Bank within a period of one month from the date of sale.

(4) The applicant shall file an affidavit of compliance along with a statement of accounts before the Registry. 16-07-2025 kak To
