Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents particularly 1st to 3rd to consider the petitioner representation dated 08.07.2024 and take a suitable action against the fourth respondent under Provision of Parents and Senior Citizen Act 2007 and protect petitioner livelihood.

ORDER

This Writ Petition has been filed for a direction, directing the respondents 1 to 3 to consider the representation submitted by the petitioner dated 08.07.2024 under Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

2. Heard the learned counsel appearing for the petitioner as well as the learned Additional Government Pleader appearing for the respondents 1 to 3 and perused the materials available on record.

3. It is seen that the petitioner lodged a complaint under Section 23 of Maintenance and Welfare of Parents and Senior Citizens Act, 2007 as against the fourth respondent, who is being the son of the petitioner, before the third respondent on 08.07.2023, which is pending for enquiry.

4. In view of the above, the third respondent is directed to conduct enquiry, after issuance of notice to the petitioner as well as the fourth respondent and after giving an opportunity of hearing to them pass orders on merits and in accordance with law within a period of twelve weeks.

5. With the above direction, this writ petition stands disposed of. No costs.
