The learned counsel for the petitioner would submit that the trial Court having found that the petitioner has proved his case had convicted the accused.

2. Whereas, the trial Court on presumption and assumption in total violation of the provisions regarding statutory presumption had acquitted the accused, without any evidence being let in by the defence that the subject cheque was issued in the name of one Eswaran and had on presumption acquitted the accused.

3. Having heard the counsel and perused the materials available on record, this Court is of the opinion that a prima facie case is made out for grant of leave.

Leave granted.
