ORDER

By consent, the writ petition is taken up for final disposal at the admission stage itself.

The writ petition is filed challenging the transfer proceedings dated 19.06.2025, issued by the first respondent and the consequential relieving order issued by the second respondent and quash the same. Learned Counsel for the petitioner would submit that the petitioner is an Office Bearer of the Trade Union and had participated in the agitation, in support of one of the employees of the depot. Therefore, in order to wreak vengeance, the first respondent transferred the petitioner through the impugned order dated 19.06.2025 and he was also issued with charge memorandum dated 07.06.2025, suspending the petitioner from service from 09.06.2025 to 15.06.2025. According to the petitioner, the said transfer is punitive in nature. Hence aggrieved by the same, the petitioner has come

before this Court.

However, the learned Standing Counsel would submit that the petitioner has blocked the bus and therefore, charge memorandum was issued on 07.06.2025. Further, he would submit that the coincidence of mere suspension and issuance of charge memorandum cannot be termed as if the impugned order dated 19.06.2025, is punitive in nature. Apart from that, even if there are any incidence as stated by the petitioner, still the management can decide the transfer of the petitioner, in order to maintain harmony in the place.

In view of the above factual submission of the learned Standing Counsel, this Court do not find any infirmity in the impugned order and consequently, the Writ Petition is dismissed as devoid of merits.
