ORDER

This Criminal Original Petition has been filed to transfer the FIR in Crime No.2233 of 2017 from the file of the respondent Police to CBCID, Chennai or any other agency to conduct fair investigation. Page No.1 of 5

2.The learned counsel for the petitioner submitted that though the FIR was registered in the year 2017, no fruitful investigation was carried out by the respondent Police. Earlier, the petitioner had approached this Court in Crl.O.P.No.22664 of 2019 seeking direction for completion of the investigation. This Court, by order, dated 22.08.2019, directed the respondent Police to file a final report within a period of three months. Despite the same, no investigation has been done. Hence, he sought for transfer of the FIR in Crime No.2233 of 2017 to some other investigating agency.

3.The learned Additional Public Prosecutor appearing for the respondent Police submitted that in this case, the investigation is almost completed and after getting report from the forensic department, final report would be filed, that to within a period of three months. The three months time is an outer limit, before that, the final report would be filed before the concerned Court.

4.It is seen that this Court in Crl.O.P.No.22664 of 2019, dated 22.08.2019 directed the respondent Police to file a final report. Despite the same, so far the investigation has not been completed. Now, the learned Additional Public Prosecutor assured that the final report would be filed within a period of three months.

5.In view of the above, the respondent Police is directed to complete the investigation in Crime No.2233 of 2017 and file a final report within a period of three months, from the date of receipt of a copy of this order. The Assistant Commissioner of Police, Ramachandra Medical College Range, Chennai is directed to monitor the investigation. 6.With the above direction, this Criminal Original Petition is disposed of.
