This miscellaneous petition has been filed seeking to condone the delay of 88 days in filing the above criminal appeal. Even though notice served on the respondent and her name also printed in the cause list, none appeared on behalf of the respondent. Heard the learned counsel appearing for the petitioner. Even though reasons stated in the accompanying affidavit are not satisfied, in order to give an opportunity to the petitioner to proceed with the appeal, this Court is inclined to condone the delay of 88 days.
