This petition is filed under Section 378 (4) Cr.P.C, to grant special leave to prefer an appeal against the judgment dated 03.06.2023 made in C.C.No.53 of 2020 on the file of the Judicial Magistrate, Fast Track Court (Magisterial Level), Thiruvannamali.

2. Heard Mr.R.Bhagawat Krishna, learned counsel for the petitioner.

3. Learned counsel for the petitioner contended that the trial Court held that the complainant has not proved the legally enforceable debt as against the accused since the purpose for which the loan was obtained by the accused, was not the purpose mentioned by the complainant in his complaint.
