Notice on the sole respondent has been served and is evident from the report of the bailiff. The respondent has neither appeared either in person or through counsel. Hence, the respondent is set exparte.

2. The learned counsel for the petitioner would submit that this Court in a similar dispute between the petitioner herein and one other Dr.Ilamvazhuthi had appointed Ms.L.Janaki, Advocate was appointed as an arbitrator to examine the issue between the parties in Arb.OP.No.17 of 2022.

3. Since the learned counsel for the petitioner would submit that the issue involved in this dispute is also similar to that of the dispute which has already been referred to arbitrator, I am of the view that it would be proper for the same arbitrator to adjudicate the dispute between the parties.

4. Hence, Ms.L.Janaki, Advocate Enrolment No.405 of 2009, Mobile No: 9788357624, is appointed as an arbitrator, to examine the issues between the parties. The arbitrator may issue notice to both the petitioner and the respondent, enter reference and proceed further in manner known to law. The arbitrator may also determine the fees to be paid for the arbitration process.

5. No further orders to be passed. The Arbitration Original Petition is

ordered accordingly.
