Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, for a direction on the basis of Detailed Representation dated 10.03.2025 to direct the 4th Respondent to release petitioners' retirement benefits Rs.15,80,000/- within a stipulated period as fixed by this Court by considering the Petitioner's age. O R D E R

By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.

The instant writ petition has been filed with a prayer for issuing a Mandamus, for a direction on the basis of Detailed Representation dated 10.03.2025 to direct the 4th Respondent to release petitioners' retirement benefits Rs.15,80,000/- within a stipulated period as fixed by this Court by considering the Petitioner's age.

3. Heard the learned counsel for both sides and perused the materials available on record.

The learned counsel for the petitioner would submit that the petitioner has joined in the services of the 4th Respondent/Society and he retired from service on 31.07.2022, and since then, the respondents did not settle the retirement benefits. In this connection, the petitioner had sent a representation to the respondents on 10.03.2025 and such representation is pending with the respondents.

At this juncture, the learned Special Government Pleader appearing for the respondents would submit that the petitioner has to pay loan amount to the respondents and that they would settle the eligible terminal benefits after adjusting the loan amount. The learned Special Government Pleader would also submit that the respondents have made part payment of Rs.2,50,000/-.

6. At this juncture, the learned counsel for the petitioner would submit that he has already settled the entire loan due. 3/6

In such view of the disputed facts, this Court instead of going into the merits of the writ petition, deems it appropriate to direct the respondents to consider the petitioner's representation dated 10.03.2025 and pass orders on it's own merits and in accordance with law, within a period of six weeks from the date of receipt of copy of this order.

8. On considering the above representation, if the petitioner is eligible for the terminal benefits, the respondents are directed to settle the same along with interest at the rate of 6% per annum from the date of his retirement.

9. With the above directions, the Writ Petition is disposed of. No costs. 09.07.2025 Index : Yes/No Speaking order dm 4/6
