It is submitted that the second respondent in the appeal died. 2.C.M.P.Nos.18180, 18182 & 18184 of 2023 are filed to condone the delay of 38 days in filing the petition to set aside the abatement, to set aside the abatement and to substitute the legal representatives of the deceased second respondent. 3.This Court by order dated 04.01.2024, issued notice to the proposed respondents 6 and 7 and their names have been printed in the cause list. There is no representation on their behalf.

4.Perused the affidavits filed in support of these petitions and being satisfied with the reasons, the Civil Miscellaneous Petitions are ordered. 5.Registry is directed to carry out the necessary amendment. 6.In the Second Appeal, the third respondent is yet to be served. 7.Fresh notice to the third respondent returnable by 28.02.2024. Private notice is also permitted.

8.Post the Second Appeal on 28.02.2024.
