ORDER

This writ petition has been filed challenging the impugned rejection letter issued by the 1st respondent dated 25.07.2022 and for a consequential direction to issue passport to the petitioner based on the application submitted by the petitioner.

2.Heard Mr.P.Vijendran, learned counsel appearing on behalf of the petitioner Mr.M.Ramamoorthy, learned Central Government Senior Panel Counsel appearing on behalf of the 1st respondent and Mr.V.Meganathan, learned Government Advocate appearing on behalf of the 2nd respondent.

3/6 3.It is seen from the impugned proceedings of the 1st respondent that the criminal proceedings case before the 2nd respondent in Crime No.103 of 2018 has been stated as the reason for non-processing the application submitted by the petitioner. It is also seen that the investigation has been completed and police report has been filed and it has not been taken on file. 4.The mere registration of an FIR or police report filed before the Court cannot be a ground to deny processing an application for issuance of passport. There is no case pending against the petitioner as on the date when the 1st respondent issued the rejection order.

5.In view of the above, there shall be a direction to the 1st respondent to process the application submitted by the petitioner and issue passport in the name of the petitioner, if he has satisfied all the other requirements. This process shall be completed, within a period of four weeks from the date of receipt of copy of this order.
