Respondents Prayer: Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the first respondent to file an action taken report on petitioner's representation dated 31.07.2013 against the fifth respondent and submit the action taken report before this Court on the said complaint within a stipulated time may be fixed by this Court.

ORDER

Heard Mr.C.Veeraraghavan, learned counsel for the petitioner, Mr.R.Vijayakumar, learned Additional Government Pleader appearing for R1 to R4 and Mr.R.M.Muthukumar, learned counsel for R5.

2.This writ petition has been filed directing the first respondent to file an action taken report on petitioner's representation dated 31.07.2013 against the fifth respondent and to submit the action taken report before this Court on the said complaint, within a stipulated time may be fixed by this Court. 3.The case of the petitioner is that the fifth respondent herein is not implementing the projects announced by the Government of Tamil Nadu and without following the guidelines formed by the Government of Tamil Nadu, he acted in his own against the welfare of the village public. According to the petitioner, the fifth respondent was spending the public money to purchase the materials without the permission of the first respondent and caused loss to the tune of Rs.6,27,752/-.

In this regard, the petitioner made representation to respondents 1 to 4 on 31.07.2013 in person to initiate appropriate against the fifth respondent. In turn, the second respondent on 07.08.2013 directs the fourth respondent to conduct an enquiry and directed to submit report against the fifth respondent and to send an inspection report to him. Even after the suitable directions given by the second respondent, the fourth respondent herein neither conducted an enquiry nor forwarded any report to the second respondent till date. Aggrieved over the same, the petitioner is before this Court. 4.In the light of the above, there shall be a direction to the fourth respondent to consider the petitioner's representation dated 31.07.

2013, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after giving notice to the petitioner and the fifth respondent. 5.Accordingly the writ petition is disposed of.
