The Criminal Miscellaneous Petitions have been filed by the petitioners/accused to modify the conditions imposed by this Court in Crl.O.P.Nos.13829 and 13392 of 2024 dated 19.06.2024 directing the petitioners to deposit a sum of Rs.15 lakhs each to the credit of crime number.
2. The learned counsel for the petitioners submitted that this Court by order dated 19.06.2024, had granted interim anticipatory bail to the petitioner in Crl.O.P.No.13829 of 2024 and granted bail to the petitioner in Crl.O.P.No.13392 of 2024 on condition to deposit a sum of Rs.15 lakhs each to the credit of crime number. He would submit that the petitioners are unable to raise such a huge amount and thereby, they could not comply with the said condition. Hence, he prayed to modify the said condition.
3. The learned counsel for the intervenor raised strong objections stating that after the grant of interim anticipatory bail/bail, the matter was lister for more than 8 times during which, the petitioners sought time to 1/3
comply with the said condition and now they have taken the present applications seeking modification of the said condition.
4. It is seen that after the grant of interim anticipatory bail/bail, the matters have been listed several times and time was also granted to the petitioners to comply with the said condition. However, now the present applications have been filed seeking modification of the said condition. On seeking the conduct of the petitioners, this Court is not inclined to modify the said condition.
5. Accordingly, the Criminal Miscellaneous Petitions are dismissed.
6. However, two weeks time is granted to the petitioners to comply with the order of this Court.
7. Post the Criminal Original Petitions on 07.11.2024 "for reporting compliance".
