On the complaint given by Senthil Mohan (Petitioner herein) the respondent police has registered the case in Cr.No.6 of 2014 against one Jayapaul and his wife Archana Kumari for the alleged offences under Sections 406, 420 and 506(i) of IPC. Final report in the case was filed on 30.06.2016 and the same was taken on file in C.C.No.81 of 2016. Alleging that till date prosecution has not commenced examination of witnesses, the present petition is filed for expeditious disposal of the case.
2. The learned Government Advocate (Crl.Side) submits that the delay in commencing the trial was due to absence of accused one after the another and pendency of Non bailable warrant against them. The matter is posted today (02.08.2024) for examining of L.W.1 to L.W.3. It is also submits that the prosecution proposed to examine 20 witnesses.
3. In the above facts and circumstances, it is directed to the respondent police to marshall their witness on every hearing dates and complete the trial without any undue delay. If accused failed to cooperate for trial and abstain themselves, necessary steps to be taken for cancellation of bail and remand them till the disposal of the trial to ensure 2/4
the trial is not delayed unnecessarily.
