This Contempt Petition has been filed praying to punish the respondent for wilfully disobeying the order of this Court passed in Crl.O.P.No.19793 of 2023, dated 29.08.2023.
2. When the matter was taken up for hearing, learned Government Advocate [Crl.side] filed the affidavit of the respondent. The relevant portions are extracted hereunder: "6. It is submitted that based on the above order, I have sent summon to the de-facto complainant for furnishing the documents related to the above said matter on earlier occasions on 25.07.2022, 03.08.2023 and 08.09.2023. But the de-facto complainant did not submitted the relevant documents before the respondent police. Further, based on the witnesses statement and material evidences, on 01.10.2023, the Tr.Gurumoorthy, the then Inspector of Police closed this case in Crime No.666 of 2022 as "Further Action Dropped" and R.C.S. Notice No.152/2023 dated 01.10.2023 was served to the de-facto complainant on 22.08.2024 by R.P.A.D.
7. I submit that as per the court order, after completion of elaborate and detailed investigation, it was evident that there was no materials to sustain the charges. Hence, the Crime No.666/2022 has been closed as "Further Action Dropped" and file a final report before the Judicial Magistrate No.II, Cuddalore, vide e-filing No.20220002063C20240082 dated 21.08.2024." 2/4
Recording the above, this Contempt Petition is closed. If the de facto complainant is aggrieved, it is always left open to the de facto complainant to work out his remedy by way of filing a protest petition. 23.08.2024 Index: yes/no Speaking Order/Non-Speaking Order gm 3/4
