This Petition has been filed under Section 232 and 276 of the Indian Succession Act 1925, seeking grant of Letters of Administration with Will annexed relating to the Last Will of Miss.S.Agnes, who died as spinster on 24.05.2019. She had executed a Will dated 05.12.1996 registered as Document No. 178/III/1996 in the Office of the Sub Registrar, Mylapore. The petitioners were the beneficiaries under the Will.

2. The mother of the deceased had also died on 28.12.1968. The first petitioner was examined as PW-1 and she marked the death certificate of Lourdammal @ Lourdumary, mother of S.Agnes as Ex.P-2 and the legal heirship certificate as Ex.P-3. A copy of Ex.P-2 alone had been marked. The Original Will had been marked as Ex.P-4. The death certificate of S.Agnes was marked as Ex.P-7.

3. Thereafter, the attesting witnesses I.Antony Raj was examined as PW-2. She identified the Will. She stated that she had signed the Will as first attestor. She also affirmed the signature of S.Agnes. She also filed her affidavit which was marked as Ex.P12. https://www.mhc.tn.gov.in/judis

4. In view of the evidence recorded, this Original Petition stands allowed as follows:- (a) the letters of administration shall be issued in favour of the petitioners in respect of the properties mentioned in the petition.

(c) The petitioners are directed to duly administer the said properties of the deceased.

(d) The petitioners are also directed to execute a security bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) in favour of the Assistant Registrar (O.S-II), High Court, Madras. (e) The petitioners are further directed to render true and correct accounts once in a year.
