ORDER

This contempt petition has been filed for the alleged disobedience of the orders of this Court dated 27.09.2022 made in W.P.No.25794 of 2022.

2. The learned counsel appearing for the respondent on appearance would submit that, on 30.03.2023 itself considering the representation given by the petitioner it was rejected and orders have been communicated to the petitioner and a copy of which also annexed in the typed set of papers filed by the petitioner in support of this contempt petition.

This position though has not been controverted by the learned counsel appearing for the petitioner, he would submit further that, the manner in which the disposal has been made by the respondent through his order dated 30.03.2023 is not in consonance with the legal procedure established under law, therefore on that count the contempt petition can be persuaded further, he contended.

I am not impressed with the same because direction was given by this Court to consider the representation and to pass orders, which have been complied with by the respondent may be in the negative manner, but that will not give rise to the petitioner to maintain this contempt petition anymore. With liberty to challenge the said order dated 30.03.2023, if the petitioner is advised to do so, I feel that this contempt petition may be closed, accordingly it is closed. 11.10.2023 Index : Yes / No Speaking Order : Yes / No Sgl 3/4
