This Criminal Original Petition has been filed by the petitioner/A2, who was arrested and remanded to judicial custody on 13.06.2024, seeking bail in Crime No.200 of 2024 registered for the offence under Sections 406 & 420 of IPC.

2. Learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner, who was no way connected with the alleged offence, has been suffering incarceration from 13.06.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he sought for bail.

3. Learned Government Advocate (Criminal Side) appearing for the respondent raised objection stating that, the petitioner/A2 along with A1, under the guise of doing gold business, had approached the de facto complainant and received 780.620 grams, thereafter, cheated him by not returning 514.730 grams of gold jewels. He further submitted that the investigation in this case is not yet completed and no recovery was made from the accused. He also submitted that one previous case of similar nature is pending against the petitioner, therefore, if he is released on bail, there is every possibility of him absconding and not available for further investigation. https://www.mhc.tn.gov.in/judis

Taking into consideration the facts and the submissions made by the learned Government Advocate (Crl.Side) and taking note of the facts that the investigation in this case is not yet completed and no recovery was made from the accused and also considering the conduct of the petitioner, this Court is not inclined to grant bail to the petitioner.
