The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 153A (1)(a) and 505 (1)(c) of IPC, in Crime No.311 of 2022, seeks anticipatory bail.
2. The case of the prosecution is that on 29.06.2022 in front of the BSNL Office, the petitioner along with 45 others assembled unlawfully on behalf of the SDPI party raised a slogan, protested and condemned against the arrest of Human Rights Fighter viz.., Mr.Sri Kumar IPS and Mr.Subair, Journalist. Hence, the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent submits that the petitioner along with 45 others assembled unlawfully on behalf of the SDPI party raised a slogan, protested and
condemned against the arrest of Human Rights Fighter viz.., Mr.Sri Kumar IPS and Mr.Subair, Journalist. He would further submit that there are 24 previous cases pending against the petitioner. He would also submit that this is the second anticipatory bail filed by the petitioner. Earlier petition filed by the petitioner in Crl.O.P.No.20291 of 2022 was dismissed on 26.08.2022. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.
5. Considering the above facts and circumstances of the case and the bad antecedents of the petitioner and that there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 27.09.2022 mn
