ORDER

This Civil Revision Petition seeks for expeditious disposal of D.V.C.No.94 of 2022 on the file of learned XXIII Metropolitan Magistrate, Saidapet, Chennai.

2. The civil revision petitioner is the wife. She initiated the proceedings against her husband and in-laws invoking the provisions of the Protection of Women from Domestic Violence Act, 2005. The relief that 1/4

she seeks for is under Sections 18, 19, 20, 22, 23, 24 and 29 of the said legislation. She would state that though the proceeding was initiated in the year 2022 and despite a mandate under the said Act to dispose of the proceeding within a specified period, the same has not been taken up for disposal.

3. Taking into consideration the plea that was made by the civil revision petitioner, I called for a report from the learned XXIII Metropolitan Magistrate, Saidapet, Chennai on 22.08.2024. I requested the learned Magistrate to state as to how long he would require for disposal of the said proceeding.

4. In compliance of the order, dated 22.08.2024, a report has been sent by the learned XVIII Metropolitan Magistrate stating that he is holding the additional charge for the XXIII Metropolitan Magistrate Court and is also managing his own Court. He states that on account of the administrative and judicial work that is being managed in both the Courts, the case has not even come up for a single date of hearing from the time he 2/4

took the charge. However, he would plead that he would take necessary steps to dispose of the D.V.C proceeding as early as possible.

5. Taking into consideration that the petitioner has completed her evidence and the matter is posted only for recording of the evidence by the defence, I am inclined to grant three months from the date of receipt of a copy of this order, for the learned Magistrate to dispose of D.V.C.No.94 of 2022.
