ORDER
This Criminal Original Petition is filed for a direction to consider the petitioners' bail application in connection with Crime No.127 of 2026 on the file of the respondent Police on their surrender and pass orders on merits on the same day.
2. The contention made on behalf of the petitioners is that the provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 has wrongly been invoked and that the petitioners are willing to surrender along with the bail application and that the contentions relating to the merits of the averments made is taken note of.
3. Considering the above and the totality of the circumstances, the following directions are issued:
(i) the petitioners shall surrender before the learned Principal District and Sessions Judge for SC/ST Act Cases, Erode and file a bail application with reference to Crime No.127 of 2026 and the same shall be 2/4
considered on merits on the same day;
(ii) the petitioners will also be entitled to serve a copy of the surrender petition and the bail application in advance so that the respondent Police shall furnish a copy of the same and complete the service on the de facto complainant well in advance; (iii) simultaneously, it will also be open to the petitioners to serve a copy to the de facto complainant.
