PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents herein to consider the petitioner's representation dated 01.11.2023 for unblocking and deleting the wrong entries made in the revenue records in respect of the land measuring an extent of 0.10.5 hectares, comprised in Survey No.43/8, B.Pallipattu Village, Pappireddipatty Taluk, Dharmapuri District and to issue computerised patta and chitta to the petitioner on the basis of the recommendation made by the 4th respondent vide Na.Ka.6324/2023/B3 dated 02.01.2024 within the time to be stipulated by this Court.

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of Mandamus to consider the petitioner's representation dated 01.11.2023 for unblocking and deleting the wrong entries made in the land records in respect of the land measuring an extent of 0.10.5 hectares, comprised in Survey No.43/8, situated at B.Pallipattu Village, Pappireddipatty Taluk, Dharmapuri District and to issue computerised patta and chitta to petitioner on the basis of recommendation made by 4th respondent vide Na.Ka.6324/203/B3 dated 02.01.2024.
3. It is submitted by the learned counsel for petitioner that the subject land belonged to petitioner's mother and was originally classified as "Anatheenam". It is further stated that in view of the possession of the land for a long time, the Special Tahsildar vide proceedings in A.M.No.51/1415 dated 25.04.2006, reclassified the land as "Patta Land" and mutated the patta in name of petitioner's mother vide Patta No.412. While so, petitioner's mother died on 11.10.2008, 2/6
leaving behind petitioner and his brother Elango as her legal heirs. Petitioner stated that he obtained No Objection Certificate from his brother thereafter the patta was transferred in his name vide P.V.48/10 dated 15.09.2010. It is submitted that petitioner applied for computerised patta and found that the subject land was again re-classified as "Anatheenam" without issuing any notice. Petitioner submitted a representation to the 3rd respondent on 01.11.2023, who in turn forwarded it to the 4th respondent. Thereafter, 4th respondent conducted an enquiry and forwarded a report dated 02.01.2024 to the Revenue Divisional Officer (RDO), however, the same is stated to be kept pending. Hence, this writ petition.

At the outset, it is submitted by Mr.A.Selvendran, learned Special Government Pleader for respondents that re-classification would require the RDO to process the above request in terms of Circular dated 31.03.2022 and forward it to the District Collector. He would further submit that thereafter the District Collector would forward the same to the appropriate authority for issuance of appropriate orders and that the above process would be completed within a time frame to be fixed by this Court. Agreed to by the learned counsel for petitioner.

In view thereof, writ petition stands disposed of with a direction to the Revenue Divisional Officer to process the petitioner's request for re-classification of subject land in terms of Circular dated 31.03.2022 and forward the same to the District Collector. The concerned District Collector shall forward the same to the appropriate authority, who in turn shall consider and pass orders in accordance with law. The entire exercise shall be completed within a period of 16 weeks from the date of uploading of web copy without waiting for receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
