ORDER

The petitioner/wife seeks transfer of H.M.O.P.No.345 of 2023 on the file of the Subordinate Judge, Tambaram, Chengalpet District to the file of the Sub-Court at Karakudi, Sivagangai District. Page No.1 of 4

2. The petitioner is the wife and the respondent in H.M.O.P.No.345 of 2023 pending on the file of the Subordinate Judge, Tambaram, Chengalpet. The petitioner has expressed genuine difficulties in attending the hearings before the Subordinate Judge, Tambaram.

3. The learned counsel for the respondent fairly submits that the respondent has no serious objection for allowing this Transfer Civil Miscellaneous Petition, however he seeks a direction for early disposal of H.M.O.P.No.345 of 2023, which is pending from 2023 onwards.

4. In the light of the above, this Transfer Civil Miscellaneous Petition is allowed and the case in H.M.O.P.No.345 of 2023 is hereby withdrawn from the file of the Subordinate Judge, Tambaram, Chengalpet District and transferred to the file of the Sub-Court at Karakudi, Sivagangai District. On such transfer, the Sub-Court, Karakudi, Sivagangai District shall take necessary steps to conclude the trial in H.M.O.P.No.345 of 2023 and dispose of the same on or before 31.10.2025. It is made clear that the Sub-Court, Karakudi, Sivagangai District shall not insist on the physical appearance of the respondent for Page No.2 of 4

all hearings and his presence may be required only for hearings where it is absolutely necessary, for example, the chief examination/cross examination. There shall be no order as to costs.
