This Criminal Original Petition has been filed by the petitioner/A2, who was arrested and remanded to judicial custody on 24.06.2024, seeking bail in Crime No.02 of 2024 registered for the offence under Sections 328 & 304(ii) of IPC.

2. Learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner was no way connected with the alleged offence and due to the previous enmity, he was dragged into this case. He also submitted that the petitioner has been suffering incarceration from 24.06.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he sought for bail.

3. Learned Government Advocate (Criminal Side) appearing for the respondent raised objection stating that, after consuming the spurious liquor, 63 persons have lost their lives and many people are admitted in the hospital at Kallakurichi. He further submitted that the petitioner/A2 was also involved in the said Kallakurichi hooch tragedy. He further submitted that the case is under investigation, therefore, if he is released on bail, there is every possibility of him absconding and not available for further investigation.

Taking into consideration the facts and the submissions made by the learned Government Advocate (Crl.Side) and taking note of the facts that the investigation in this case is still pending and also considering the nature and gravity of the offence committed by the accused, this Court is not inclined to grant bail to the petitioner.
