ORDER

This petition has been filed by the wife seeking transfer of O.P.No.1324 of 2021 pending on the file of the learned Additional Judge, Family Court, Coimbatore, which is filed by her husband for restitution of conjugal rights, to the file of the learned Judge, Family Court, Dharmapuri.

2.The reasons for seeking the transfer was on account of the fact that the petitioner is residing at Pennagaram, Dharmapuri District, and she cannot travel alone to Coimbatore to attend every hearing. The petitioner would further submit that her parents are aged and sick and she has no one to accompany her to Coimbatore.

3. The respondent though served has not entered appearance.

4. Heard the learned counsel for the petitioner and perused the records.

5.Considering the reasons given and the fact that the wife is residing at Pennagaram, Dharmapuri District, this Court is of the considered view that the request for transfer should be allowed.

6.Accordingly, the Transfer Civil Miscellaneous Petition is allowed and O.P.No.1324 of 2021 pending on the file of the learned Additional Judge, Family Court, Coimbatore, is withdrawn and transferred to the file of the learned Judge, Family Court, Dharmapuri.

No costs.

Consequently, connected Civil Miscellaneous Petition is closed.
