Prayer: Writ Petition is filed under Article 226 to issue a Writ of Certiorarfied Mandamus, to call for the records of the impugned order dated 26.03.2024 vide proceedings No.O.Mu.1750/022/S1 passed by the 2nd respondent, quash the same and further direct the 2nd and 3rd respondents to survey the land situated in S.No.736/1B2, Periyapuliyur Village, Bhavani Taluk, Erode District, and subdivide the same and thereby issue a fresh patta to the petitioner as per the direction issued by the 1st respondent on 06.02.2024.

The Writ Petition is filed to call for the records of the impugned order dated 26.03.2024 vide proceedings No.O.Mu.1750/022/S1 passed by the 2nd respondent, quash the same and further direct the 2nd and 3rd respondents to survey the land situated in S.No.736/1B2, Periyapuliyur 2/6

Village, Bhavani Taluk, Erode District, and subdivide the same and thereby issue a fresh patta to the petitioner as per the direction issued by the 1st respondent on 06.02.2024.

2. Heard the learned counsels on the either side and perused the records.

3. Admittedly, 22 cents of land have been given in excess in patta to the 4th respondent, which the 4th respondent also accepts. Both the parties consent that 3 Acres 21 Cents belonging to the 4th respondent shall be surveyed.

4. Accordingly, the 2nd respondent is directed to survey, measure and subdivide the subject property as per the documents under which the 4th respondent has purchased the property and as per the documents under which her vendor, Senkottaiyan had purchased the property on 14.06.2005. The parties shall cooperate in the survey, measurement and subdivision of the properties and patta shall be issued accordingly 3/6

corrected.
