The petitioner who apprehends arrest at the hands of the respondent police for the offences under Sections 447, 294(b) and 506(ii) of IPC r/w Section 4 of WH Act and Section 3 of TNPPD Act, in Crime No.651 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that due to land dispute the petitioner along with other accused abused the defacto complainant and also damaged the pipeline worth Rs.1,000/- belonging to the defacto complainant. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner has been falsely implicated in this case and he is ready and willing to abide by any stringent conditions that may be imposed on him. Therefore, he prays to grant anticipatory bail to the petitioner. 1/5

4. The learned Additional Public Prosecutor would submit that there are totally six previous cases, similar in nature, pending against the petitioner. He further submit that this Court has already dismissed the anticipatory bail application for this petitioner in Crl.O.P.No.19806 of 2022 on 23.08.2022. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

Considering the nature of offence committed by the petitioner and taking note of the fact that there are six previous cases, similar in nature, pending against the petitioner and this Court had already dismissed the anticipatory bail application for this petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Original petition is dismissed. 02.09.2022 smn 2/5
