The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 395, 294(b) and 506(ii) of IPC in Crime No.367 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were celebrating the birthday of one of their friends by cutting a "Aruval shaped Cake" near the bus stand and when the same was questioned by the defacto complainant the petitioner threatened him with knife point. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner has been falsely implicated in this case and he is ready and willing to abide by any stringent conditions that may be imposed on him. Therefore, he prays to grant anticipatory bail to the petitioner. 1/5

4. The learned Additional Public Prosecutor would submit that there are totally two previous cases, similar in nature, pending against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the nature of offence committed by the petitioner and taking note of the fact that there are two previous cases, similar in nature, pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, the Criminal Original petition is dismissed. 02.09.2022 smn 2/5
