ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 22.08.2021 for the offences under Sections 341, 307 and 506(ii) of IPC, in Crime No.121 of 2021, seeks bail.

2.The case of the prosecution is that the victim is a sports person. On 26.06.2021 at about 13.30 hours, when the victim was proceeding in his bike near ICF Colony, an unknown person approached him and insisted to hand over his cell phone under the guise of making phone call to his friend. When he refused the same, he attacked him with bill hook and cut his nose and also caused cut injuries all over the body. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case. He would further submit that the victim has been discharged from the hospital and the petitioner has been suffering incarceration for more than 75 days from 22.08.2021. Hence, he prays for grant of bail to the https://hcservices.ecourts.gov.in/hcservices/

petitioner.

4.The learned Government Advocate raised strong objection stating that though the victim has been discharged from the hospital, during the incident his nose got cut for which, he has to undergo a surgery and that the petitioner has got two previous cases against him.

5. It is seen that the victim is still under treatment and that the petitioner has got two previous cases against him. Therefore, this Court is not inclined to grant bail to the petitioner.
