This Criminal Original Petition has been filed by the petitioner/A2, who was arrested and remanded to judicial custody on 02.07.2024, seeking bail in Crime No.200 of 2024 registered for the offence under Section 381 of IPC.
2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He further submitted that the petitioner is the relative of the de facto complainant and a false case has been given against her. He also submitted that the petitioner has been suffering incarceration from 02.07.2024 and she is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner.
3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that the A1 had committed theft of Rs.2000/- and a passport from the de facto complainant's house and also thrown the passport in the drainage. He further submitted that CCTV footage is also available and the specific overt act against the petitioner/A2 is that she is the person who had instigated A1 to commit the offence. 4. Taking into consideration the facts and the submissions made by the learned Government Advocate (Crl.Side) that the case is under investigation and also considering the conduct of the petitioner, this Court is not inclined to grant bail to the petitioner.
