Criminal Revision Case filed under Sections 438 and 442 of BNSS, 2023, praying to set aside the order passed in Crl.MP.No.55435 of 2023 dated 20.03.2024 by the learned Metropolitan Magistrate for CCB and CBCID Case, Egmore, Chennai and direct the first respondent police to register the case on my complaint dated 11.08.2023 and direct them to investigate my complaint in accordance with law.

O R D E R

This Criminal Revision Case has been preferred against the order passed in Crl.MP.No.55435 of 2023 dated 20.03.2024 by the learned Metropolitan Magistrate for CCB and CBCID Case, Egmore, Chennai, thereby dismissing the petition filed under Section 156(3) of Cr.P.C. 2.

Heard, the learned counsel appearing on either side and perused, all the materials placed before this Court.

On perusal of records, it is revealed that the petitioner lodged complaint stating that he paid a sum of Rs.1,00,00,000/- to the counter party to avail loan to the tune of Rs.3,00,00,000/-. The petitioner also mortgaged a property. Thereafter, the counter party failed to avail loan in favour of the petitioner.

No prudent person would pay a sum of Rs.1,00,00,000/- to avail loan of Rs.3,00,00,000/-. That apart, even according to the petitioner, he had mortgaged a property in favour of the counter party. Therefore, there was some money transaction between the petitioner and the counter party. Therefore, it

was civil in nature and as such, the original complaint was rightly closed as civil in nature. Thereafter, the direction petition filed by the petitioner was rightly rejected by the trial court.

In view of the above discussion, this criminal revision case is dismissed.
