These applications have been field to condone the delay of 3553 days in filing the application to set aside the abatement of the suit caused due to the death of the first respondent and also to set aside the abatement of the suit.

2. The second defendant did not make his appearance.

3. The learned counsel for the third defendant submitted that he does not have serious objection in allowing these applications.

4. The fourth defendant is the subsequent purchaser of the suit property. The fifth defendant was already struck off by the Court.

5. Since these applications have been field to just to rectify the technical difficulty that had arisen due to the death of first defendant, notice to the other defendants are dispensed.
