A.Nos.4528, 4529 & 4530 of 2022 A.Nos.4528, 4529 & 4530 of 2022 in O.P.No.406 of 2012 C.V.KARTHIKEYAN,J., These three applications have been filed by the petitioner herein seeking permission to reopen the evidence on the side of the petitioner and to recall P.W.1 and also to mark four documents as further documents.

2. The necessity to reopen the evidence is to mark the documents. The documents can be marked only when the witness is recalled.

3. The documents which are now sought to be marked are the terms and conditions of a loan dated 09.10.1991, a Deed of Guarantee and Deed of Hypothecation both dated 11.11.1991 and a Letter confirming deposit of title deeds dated 12.11.1991.

4. All these documents are original documents and they have also been signed by the respondents herein. Even otherwise, if the respondents question the veracity of the documents, they can do so during cross examination of the witness.

5. In view of the fact that any witness, should be given necessary opportunity to produce documents to substantiate the oral evidence 1/2 https://www.mhc.tn.gov.in/judis

A.Nos.4528, 4529 & 4530 of 2022 C.V.KARTHIKEYAN,J., ssi presented, I would allow these applications and direct that the documents to be taken on record and consequently reopen the evidence of P.W.1 and also permit P.W.1 to tender evidence.
