Respondents Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus to direct the 1st respondent to upgrade to the post of Headmaster as B.T.Grade Middle School Headmaster in the petitioner School and consequently to approve the promotion of Thiru.V.Ramanujam as B.T.Grade Middle School Headmaster with effect from 3.6.2008 being the date on which he was promoted as Headmaster for which proposals were submitted by the petitioner on 20.6.2008 and which had been duly recommended by the 2nd and 3rd respondents for the Final Approval of the 1st respondent by taking into account of G.O.Ms.No.1297 dated 27.7.1979 and G.O.(Nilai) No.50 dated 22.3.2001 within a stipulated time frame. With regard to upgradation to the post of Headmaster as B.T. Grade Middle School Headmaster in the petitioner School on the basis of the recommendations made by the second and third respondents, the petitioner is awaiting appropriate orders from
the first respondent.
2.The learned counsel for the petitioner has submitted that even though proposals were submitted by the petitioner School to the authorities on 20.06.2008 itself for upgradation to the post of Headmaster as B.T. Grade Middle School Headmaster in the petitioner School for one V.Ramanujam, and recommendations have also been made by the second and third respondents, no orders have been passed by the first respondent till date. It is also submitted that the petitioner School has made several representations in this regard, the last one being dated 19.03.2012.
3.Heard the learned counsel on either side and perused the materials available on record.
4.Considering the fact that proposals for upgradation has been made as early as on 20.06.2008 by the petitioner School and the same has been recommended by the second and third respondents, the first respondent is directed to pass appropriate orders on the proposals submitted by the second and third respondents for upgradation to the post of Headmaster as B.T. Grade Middle School Headmaster in the petitioner School for one V.Ramanujam, within a period of four weeks from the date of receipt of a copy of this order, keeping in mind the orders passed by the Government in G.O.Ms.No.1297 dated 27.07.1979 and G.O.(Nilai)No.50 dated 22.03.2001.
