ORDER
The present application has been filed to grant leave to institute the above said suit before this Court against the 2nd, 4th and 5th respondents/ 2nd, 4th and 5th defendants under Order III Rule 1 of the Rules of the Original Side Madras High Court, 1965.
2. Heard the learned counsel for the applicant
3. Learned Counsel appearing for the applicant would submit that though 2nd, 4th and 5th
respondents/ 2nd, 4th and 5th defendants reside outside the jurisdiction of this Court, other respondents/ defendants are residing within the jurisdiction of this Court and hence, requested this Court to allow the present application.
4.Considering the above submissions and examining the draft plaint and the affidavit filed in support of this Application, and taking into consideration that the other respondents/ defendants are residing within the jurisdiction of this Court and being satisfied with the same, the application in A.No.2909 of 2025 is allowed by granting leave to the applicant to sue the 2nd, 4th and 5th respondents/ 2nd, 4th and 5th defendants before this Court.
