This matter came up for hearing today under the caption 'For Being Mentioned' at the instance of the learned counsel for the petitioner.

2.The learned counsel for the petitioner submits that in paragraph No.11, one sentence is missing and therefore, it gives a different meaning in the order.

3.The said submission of the learned counsel for the petitioner merits acceptance.

4.Accordingly, instead of paragraph No.11 as mentioned in the order dated 30.08.2016, the following shall be substituted: "11.Accordingly, the Writ Petition is allowed, the impugned order is set-aside and the matter is remanded to the respondent for fresh consideration, who shall obtain copies of those Bills which he relies upon and furnish the same to the petitioner and thereafter, the petitioner shall be given fifteen days time to give objections and after affording an opportunity of personal

hearing to the petitioner, the respondent shall redo the assessment in accordance with law. There will be no order as to costs. Consequently, connected Miscellaneous Petition is closed."

Rpa 03.10.2016 Note:(i) Registry is directed to issue the fresh order copy after incorporating necessary corrections in the above said order dated 30.08.2016.
