THE HON'BLE MRS.JUSTICE V.BHAVANI SUBBAROYAN W.P.No.28360 of 2008 and M.P.No.1 of 2008 A.Maheswari ... Petitioner Vs.

1. The District Collector Vellore District.

2. The District Project Officer Vellore District.

3. The Child welfare project officer Nattrampalli, Vellore district.

... Respondents Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to appoint the petitioner as Anganwadi worker/noon meal scheme organizer at Ramanayakenpatti post, Ambalur Post, Vaniyambadi taluk, Vellore District.

For Petitioner : Mr.V.Raghavachari For Respondents : Mr.R.S.Selvam Government Advocate

O R D E R

This Writ Petition has been filed to direct the respondents to appoint the petitioner as Anganwadi worker/Noon meal scheme organizer at Ramanayakenpatti post, Ambalur Post, Vaniyambadi taluk, Vellore District.

2. The petitioner's mother, namely, M.Prabavathi, had been working as an Anganwadi worker from 1984 till her death on 26.01.2008. At the time of her death, she was 53 years old and the petitioner herein is the only daughter, who survived her mother. After the death of her mother, the petitioner filed an application before the District Collector, Vellore, on 31.03.2008, for appointment to the Post of Noon meal scheme organizer and subsequently renewed from time to time on 12.05.2008, 18.08.2008, 20.10.2008. https://hcservices.ecourts.gov.in/hcservices/

3. The petitioner claims that she had studied up to XII standard and she has all the qualification for appointing her in the said post on compassionate ground. But, instead, based on the letter sent by the 2nd respondent dated 13.08.2008, the 3rd respondent had issued a letter to the petitioner calling upon her to attend an interview. Hence, the petitioner would contend that the 2nd respondent himself had called her on 04.09.2008 to furnish all the particulars of her mother, for the purpose of scrutinizing her application to appoint her on compassionate ground, but, the 2nd and 3rd respondents, without appointing her in the said post, had conducted an interview and rejected her application, and therefore, she had filed this Writ Petition before this Court, to direct the respondents to appoint her as Anganwadi worker/Noon meal scheme organizer at Ramanayakenpatti post, Ambalur Post, Vaniyambadi taluk, Vellore District.

4. The learned counsel for the parties have produced the proceedings of the District Project Officer, Vellore, in Na.Ka.No.2490/A/08 dated 06.05.2010, whereby, the petitioner has already been appointed as Anganwadi worker, as she sought for in this Writ Petition, hence, nothing survives for further adjudication.

5. Accordingly, the Writ Petition is dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
